Terms of Service

1. Agreement

These terms are a contract between you and Zeneth Pro LLC (Kissimmee, Florida, USA) covering voice.zenethpro.com and the Zeneth AI Caller service. By creating an account, starting a demo call, or using the service you accept them. The general Zeneth Pro terms at zenethpro.com/terms also apply; where these are more specific, these control.

2. The service

Zeneth AI Caller provides AI phone agents that can answer inbound calls, place outbound calls you request, send and receive text messages, transcribe and summarize conversations, and deliver results to you or the systems you connect. The service is for business use.

3. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account and API keys. You must be at least 18 and authorized to act for the business you register.

4. Plans, billing, and cancellation

• Current prices and included usage are shown on the site and at checkout. Paid plans bill monthly through Stripe until cancelled. Usage beyond included allowances (for example call minutes, phone numbers, or text segments) is metered and billed at the listed overage rates.
• Free trial accounts have limited included minutes and features and may be reclaimed after extended inactivity.
• You can cancel any time from the portal's billing page. Cancelling stops future charges and releases phone numbers attached to the account; amounts already billed are non-refundable except where the law requires otherwise.
• We may change pricing with notice; changes apply from your next billing cycle.

5. Phone numbers and telephony

Phone numbers provisioned through the service remain carrier-allocated numbers and are released when your subscription for them ends. Carrier rules, including A2P messaging registration requirements, apply to numbers and messaging. We may reassign or reclaim numbers when carriers require it.

6. Acceptable use and compliance

You are responsible for how your agents are used and for the legality of your calls and messages. You agree not to use the service for:

• Calls or texts that violate the TCPA, the Telemarketing Sales Rule, state telemarketing or robocall laws, or do-not-call registries. You are responsible for obtaining any consent required for outbound calls and messages you initiate.
• Recording calls without any consent required by the jurisdictions involved.
• Fraud, impersonation of others, harassment, threats, or deceptive practices.
• Unlawful, dangerous, or age-restricted content, or anything that violates carrier or platform policies.
• Attempting to breach, probe, or overload the platform or other customers' data.

We may suspend or terminate accounts that violate this section, and carrier or legal demands may require immediate suspension.

7. No emergency services

The service does not support emergency calls. AI agents cannot place or route calls to 911 or any emergency service. Do not rely on the service for emergency communications; keep a conventional phone line available for that.

8. AI output

Agents generate speech and text automatically. We work to keep them accurate and on-script, but AI output can be wrong or incomplete. You are responsible for reviewing important information an agent gives or collects, and for the instructions and content you configure. The service provides no legal, medical, or financial advice.

9. Your content and data

You keep ownership of the scripts, knowledge, and data you provide and of the recordings, transcripts, and summaries generated for your account. You grant us the license needed to process that content to run the service. Handling of personal data is described in the Privacy Policy.

10. Our property

The platform, software, prompts, models' configurations, site content, and branding are the property of Zeneth Pro LLC or its licensors. You may not copy, resell, reverse engineer, or extract them except as the law expressly permits.

11. Third-party services

The service depends on third-party carriers, payment processing, hosting, and AI providers. Their availability affects the service, and their own terms apply to their parts of it (for example Stripe for payments).

12. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that every call will be answered or completed.

13. Limitation of liability

To the maximum extent the law allows, Zeneth Pro LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amounts you paid us in the three months before the event giving rise to the claim.

14. Indemnification

You will defend and hold harmless Zeneth Pro LLC from claims arising out of your use of the service in violation of these terms or applicable law, including telemarketing and recording claims from your own calls and messages.

15. Termination

You may close your account at any time. We may suspend or terminate for breach, non-payment, legal or carrier requirements, or abuse, with notice where practical. Sections that by nature survive termination survive it.

16. Governing law and disputes

Florida law governs these terms. Disputes will be resolved in the state or federal courts located in Osceola County, Florida, and you consent to their jurisdiction.

17. Changes

We may update these terms; the current version always lives at this page with the date above. Material changes will be announced in the portal, and continued use after the effective date is acceptance.
